The Commissioner for the South African Revenue Service obtained final sequestration orders against both the personal estate of Mr Ngwane Roux Shabangu and the Roux Shabangu Family Trust in respect of undisputed tax debts. The court held that all statutory requirements under the Insolvency Act were met and that the applications were not mala fide or an abuse of process.
The Gauteng High Court allowed BASF South Africa’s appeal against Tax Court orders that had permitted SARS to amend its transfer pricing grounds of assessment while refusing BASF corresponding amendments to its grounds of appeal. The court held that SARS’s proposed amendments constituted a novation prohibited by Rule 31(3) of the Tax Court Rules, and that BASF’s proposed amendments were permissible under Rule 32(3).

A Swedish Administrative Court of Appeal partially upheld a company’s appeal against transfer pricing adjustments for tax years 2017 and 2018, finding that the Swedish Tax Agency had not discharged its burden of proof for restricting the arm’s length range to the interquartile range where the comparables set contained only ten companies. The court reduced the company’s taxable business income accordingly and halved the tax surcharges on grounds of unreasonably long processing time.
The Tribunal Superior de Justicia de Madrid dismissed the appeal brought by Reichle & De-Massari Iberia S.L.U. against a corporate income tax assessment for 2014, upholding the tax authority’s rejection of the company’s profit-and-loss segmentation and its application of the upper quartile of the arm’s length range. The court also confirmed the disallowance of negative taxable bases declared for 2012 and 2013.
The Tax Appeals Tribunal set aside a capital gains tax assessment of Shs. 4,235,796,666 imposed on Kuku Foods Uganda Limited following a change in its ownership structure. The Tribunal found that the correct taxing provision was section 78(h) read with section 74(2) of the Income Tax Act, but that the assessment had been wrongly computed, and remitted the matter to the Uganda Revenue Authority to recompute the tax using the prescribed statutory formula.
The Spanish Supreme Court admitted a cassation appeal brought by CUPIRE PADESA, S.A. against a transfer pricing adjustment for corporate income tax for the year 2016, identifying four questions of objective cassational interest concerning the selection and application of the profit split method to intra-group transactions in a natural stone production chain.

The Italian Supreme Court partially upheld Montebianco s.p.a.’s cassation appeal, holding that a tourist trip offered to customers under bilateral purchase contracts was not a taxable prize operation subject to withholding tax. The court also rejected the tax authority’s cross-appeal challenging the transfer pricing methodology applied by the lower court.

The Court of Appeal of Tanzania quashed the decisions of the Tax Revenue Appeals Board and the Tax Revenue Appeals Tribunal in a dispute over the deductibility of group technical assistance fees paid by Total Tanzania Limited to Total Outre Mer. The court held that the Board’s judgment was fatally defective because the Vice Chairman had failed to record reasons for disagreeing with a dissenting member’s opinion, as required by rule 15(3) of the Tax Revenue Appeals Board Rules, 2018.
The Court of Appeal dismissed HMRC’s appeal against the Upper Tribunal’s decision that approximately £90.8 million of post-administration interest received by an Irish-resident investment company on a purchased debt claim in the Lehman Brothers International (Europe) administration was exempt from UK withholding tax under Article 12(1) of the UK-Ireland double taxation treaty. The court held that neither the seller nor the buyer had a main purpose of ‘taking advantage of’ Article 12(1) within the meaning of the treaty’s anti-abuse provision, Article 12(5).
The Paris Administrative Court of Appeal upheld a tax reassessment against SARL Calliope, finding that the company had indirectly transferred profits to its Italian parent-group companies in breach of Article 57 of the French General Tax Code. The court rejected all grounds of appeal and dismissed the company’s request for reinstatement of its carry-forward deficit and discharge of additional taxes.
Lifeplus Europe Ltd successfully appealed against an HMRC information notice requiring it to produce its US parent company’s consolidated and entity-level financial statements for accounting periods ending 31 December 2014 to 31 December 2022. The First-tier Tribunal held that the documents were neither reasonably required to check the appellant’s corporation tax position nor within the appellant’s possession or power.

Brazil’s CARF upheld the cancellation of a transfer-pricing adjustment levied on PETROBRAS in respect of oil-platform charter fees for the 2019 calendar year, finding that the tax authority could not use the initial contract term as a proxy for the investor’s expected return period. The tribunal also upheld the simultaneous imposition of an isolated penalty for unpaid monthly IRPJ and CSLL estimates alongside the annual-adjustment penalty.
